General Terms and Conditions

1. General
These General Terms and Conditions (“GTC”) are an integral part of the contract between Vermarktungsgesellschaft Badminton Deutschland mbH (VBD), Südstraße 25a, 45470 Mülheim an der Ruhr, DE (“Organizer”) and the purchaser (“End Customer”) of access, participation, admission or visit authorizations or reservations and vouchers for these or similar or associated rights (“Tickets”) or other offers, products and services (e.g. merchandise) (together “Offers”), which the Organizer sells via services operated by Ticket Tailor. End customers in the sense understood here also include persons who have not purchased tickets or other offers directly from the organizer, but who are entitled to participate in an event (e.g. through secondary purchase, if permitted). © Zimma Ltd trading as Ticket Tailor (“Ticket Tailor”) is a provider of software and other services (“Ticket Tailor services”) that enable providers or operators of artistic, cultural, sporting or other events to organize their events. Ticket Tailor is a provider of software and other services (“Ticket Tailor Services”) that enable providers or operators of artistic, cultural, sporting or other performances, plays, concerts, meetings, seminars, leisure and other facilities, museums, sites, film screenings, operas, readings, trade fairs, conferences, training/educational events, courses and other events and performances (whether physical or virtual) (“Event”) to sell tickets and other offers and to process related transactions with end customers. Ticket Tailor is a provider of a technology platform for the Organizer. Ticket Tailor is not a ticket broker and is not the organizer of an Event.


2 Conclusion of contract
Upon successful completion of a purchase transaction via Ticket Tailor services, a contract is concluded exclusively between the organizer and the end customer. This also applies if tickets or other offers are marked with additions such as “powered by Ticket Tailor” or similar or if the organizer advertises, offers and sells the tickets or other offers via the domains and sub-domains of Ticket Tailor (tickettailor.com).No purchase, service or other contracts for the purchase of tickets and the event or related services are concluded between the end customer and Ticket Tailor.
The end customer is not entitled to conclude a contract with an event organizer. The end customer acknowledges that the organizer may make the conclusion of the contract dependent on the acceptance of further conditions, data protection declarations, revocation instructions and other contractual components by the end customer and further restrictions (e.g. maximum number of tickets for an event). The organizer and Ticket Tailor (on behalf of the organizer) are entitled to refuse or reject the conclusion of purchase transactions with an end customer without giving reasons. The end customer acknowledges that the total purchase price of a purchase transaction is determined or changed solely by the organizer and may exceed the ticket price shown on a ticket or in the ticket store. The total purchase price is calculated by adding any fees and taxes to the ticket price shown. The total purchase price to be paid by the end customer will be communicated to the end customer before the order process is completed.
Payment of the total purchase price can only be made via the payment methods provided by the organizer or Ticket Tailor (on behalf of the organizer). The contract between the organizer and the end customer is only concluded with the corresponding confirmation to the end customer by Ticket Tailor (on behalf of the organizer) (e.g. by sending the transaction confirmation or allocation and subsequent sending of a ticket with the corresponding ticket ID). Going through the ordering process alone does not constitute the conclusion of a contract and does not entitle the end customer to participate in an event. In the event that ticket contingents (both the total contingent of the event and contingents of individual ticket categories) are exceeded due to technical problems, the organizer or Ticket Tailor (on behalf of the organizer) shall inform the end customer of this. The organizer or Ticket Tailor (on behalf of the organizer) can cancel the corresponding tickets and refund the total purchase price.
Ticket Tailor acts as a payment processor for certain transactions carried out via our website(s) and on site.
This means that Ticket Tailor is responsible for processing and fulfilling orders, processing payments and dealing with customer queries in relation to these orders. By using our website, engaging with us and providing the Ticket Tailor platform to customers, you agree that Ticket Tailor is the payment processor for these transactions and that any issues or disputes (including refunds and chargebacks) that arise in relation to these transactions will be dealt with by us in accordance with our terms and conditions.
3. Ticket form
Unless otherwise communicated by the organizer or Ticket Tailor  (on behalf of the organizer), the end customer will receive an automatic order confirmation email from Ticket Tailor (on behalf of the organizer) and another email with a link to the purchased tickets for the corresponding event. The form of the tickets provided depends on which entry and admission modalities the organizer uses for a particular event and is communicated to the end customer (e.g. downloading and printing, digital wallet, etc.).
To participate in an event, the ticket must be presented in the form communicated. Presentation of the order confirmation email alone (without presentation of the ticket in the correct form) does not entitle the customer to attend an event.
If provided for by the organizer, the end customer has the option of ordering printed and mailed tickets for a fee (“hard tickets”).
The end customer is obliged to check a ticket after delivery or receipt for correctness with regard to number, price, date, event, venue and other essential features. Complaints about incorrect tickets must be made to the organizer or Ticket Tailor (on behalf of the organizer) immediately, at the latest within five working days of handover or receipt of the ticket.

The transfer of ownership of tickets or rights derived from them to the end customer shall not take place until the total purchase price has been paid in full or all outstanding claims have been settled.
As part of the purchase process, the end customer must provide truthful, complete and correct information. The organizer or Ticket Tailor (on behalf of the organizer) are entitled to check the end customer’s details by means of suitable measures (e.g. credit information).

4. Rights and obligations
All information relevant to an event or other offer of the organizer (e.g. scope/content, location, time, organizer, price, fees and taxes, participation requirements and restrictions, access controls and restrictions, form of tickets to be presented, accessibility, hall plan, house rules and other rules of conduct of the respective venue and other restrictions or essential information that could reasonably influence the purchase decision of an end customer) will be communicated by the organizer or Ticket Tailor (on behalf of the organizer).
The end customer hereby acknowledges this information and these regulations and are therefore part of the contract between the organizer and the end customer. It is the sole responsibility of the end customer to check whether they can or wish to fulfill the requirements, conditions, provisions and regulations necessary for participation. The organizer may refuse or terminate participation or attendance at an event in the event of non-compliance or non-observance.
If there is a suspicion of abuse or violation of legal provisions, these GTC or other provisions or conditions of the organizer (e.g. through fraudulent, illegal or unfaithful activities) or of corresponding circumvention or attempts at circumvention, the organizer or Ticket Tailor (on behalf of the organizer) may revoke the validity of a ticket without compensation before or during an event and deny the end customer the right to participate in an event or expel him/her from the event.
The end customer must inform the organizer and Ticket Tailor immediately of any damage, loss or seizure of tickets. If the end customer loses a hard ticket or if it is lost in his area of responsibility, the organizer or Ticket Tailor are not obliged to provide a replacement.
Unless otherwise agreed, the validity of a ticket is limited to the respective event (in particular in terms of location and time) and, if applicable, the respective seat or seating unit or the corresponding ticket category. Once the event has taken place, the ticket loses its validity.
The end customer acknowledges that the organizer is solely responsible for events and other offers of the organizer that are offered and processed via Ticket Tailor services, as well as their content, quality, procedure, implementation, modification, cancellation, termination or postponement, the corresponding communication, publications and information, and that Ticket Tailor is in no way responsible for this. Ticket Tailor is under no obligation to instruct, check or supervise the Organizer with regard to its obligations to end customers. Ticket Tailor is also under no obligation to check the Organizer’s publications and information for their topicality, legality, correctness and completeness. This also applies in particular if employees of Ticket Tailor act on behalf of the organizer or if the organizer uses contractual documentation and templates provided by Ticket Tailor.
The end customer further acknowledges that Ticket Tailor offers no guarantee of uninterrupted accessibility and usability of the Ticket Tailor services. Ticket Tailor accepts no liability for delays or errors in transmission, memory failures and associated restrictions of the Ticket Tailor Services.

Please note that there may be temporary interruptions to the website and/or individual Ticket Tailor services in the course of maintenance work.

5. Passing on tickets
Tickets may be resold. The organizer must be contacted for the re-personalization of individualized tickets. A processing fee may be charged for this.

6. Revocation, cancellation, refund, return and exchange of tickets
Without significant change to the event
There is no right of revocation, return, cancellation or exchange for events (in particular for services in connection with leisure activities if the contract provides for a specific date or period for the provision of the service, within the meaning of Section 312g (2) No. 9 BGB). Each purchase of tickets is therefore binding immediately after completion of the purchase process and cannot be canceled.
Significant changes, postponement or cancellation of the event
In the event of a significant change, postponement or cancellation of an event due to circumstances for which the organizer is not responsible, the end customer is entitled to return the tickets and receive a refund of the ticket price, less any cancellation costs.

Exchanges, refunds and repayments are processed by Ticket Tailor on behalf of the organizer. The refund to the end customer is made via a payment infrastructure selected by Ticket Tailor (on behalf of the organizer).
A change is significant if the changed event differs fundamentally from an event that the ticket purchaser may reasonably expect.

7. Liability
The organizer shall only be liable for intent and gross negligence, except in the case of breach of material contractual obligations, injury to life, limb or health and the provisions of the Product Liability Act. Liability for a slightly negligent breach of material contractual obligations is limited to the transaction value associated with the transaction giving rise to liability. In principle, the organizer is not liable for damages caused by force majeure or breaches of duty by third parties.
Insofar as the Organizer’s liability is excluded or limited, this exclusion or limitation of liability shall also apply mutatis mutandis to any personal liability of the Organizer’s legal representatives, vicarious agents and assistants as well as any representatives acting on behalf of the Organizer vis-à-vis the end customer. If Ticket Tailor acts on behalf of or as a vicarious agent of the organizer towards the end customer or otherwise appears vis-à-vis the end customer, the following applies: Ticket Tailor is only liable for intent and gross negligence – except in the event of a breach of any material contractual obligations, injury to life, limb or health and the provisions of the Product Liability Act. Liability for a slightly negligent breach of material contractual obligations is limited to the transaction value associated with the transaction giving rise to liability. In principle, Ticket Tailor is not liable for damages caused by force majeure or breaches of duty by third parties.
Insofar as Ticket Tailor’s liability is excluded or limited, this exclusion or limitation of liability also applies mutatis mutandis to any personal liability of Ticket Tailor’s legal representatives, vicarious agents and assistants as well as any representatives acting on behalf of Ticket Tailor vis-à-vis the end customer. Ticket Tailor is not liable in particular for damages resulting from the cancellation, cancellation, change, postponement or defects of an event, insolvency of the organizer, loss or late arrival or incorrect hard tickets as well as restrictions of the Ticket Tailor services.
8. Final provisions
These General Terms and Conditions take precedence over any other provisions in the contractual relationship between the organizer and the end customer.
The law of the Federal Republic of Germany shall apply to the exclusion of the provisions of international private law and the United Nations Convention on Contracts for the International Sale of Goods (CISG – UN Sales Convention). The statutory provisions restricting the choice of law and the applicability of mandatory provisions shall remain unaffected by this.
If the end customer is not a consumer, the exclusive place of jurisdiction for all disputes between (i) the end customer and the organizer is the registered office of the organizer and (ii) the end customer and Ticket Tailor is London, England.
The end customer is deemed to be a consumer insofar as the purpose of the ordered deliveries and services cannot be attributed to his commercial or independent professional activity. Any natural or legal person or partnership with legal capacity that is acting in its commercial or independent professional capacity when concluding the contract is deemed to be an entrepreneur. The end customer is not considered a consumer when purchasing services in connection with leisure activities if the contract provides for a specific date or period for the provision of the service (as defined in Section 312g (2) No. 9 BGB). The following applies to end customers with their registered office, domicile or habitual residence in the European Union:
The end customer warrants that he/she has unlimited legal capacity or the necessary powers of representation to conclude this contract.
The European Commission provides at https://ec.europa.eu/consumers/odr an internet platform for online dispute resolution (ODR platform). The organizer and Ticket Tailor are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Should any of the aforementioned provisions be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The same applies if and insofar as a loophole is found. In place of the invalid or unenforceable provision or to fill the gap, an appropriate provision shall apply which, as far as legally possible, comes closest to what Ticket Tailor and the end customer would have wanted economically if they had considered this point.

9. Further provisions of the organizer
The following additional provisions of the organizer apply:
In addition to the General Terms and Conditions of Ticket Tailor, the following conditions apply to purchasers of tickets for the advertised badminton events on this website
(1) Ticket discounts
Reduced tickets: Eligible are children/young people aged 12-17 as well as pupils, students, volunteers, pensioners, severely disabled persons, unemployed persons (all exclusively on presentation of a corresponding ID). Eligibility to purchase reduced-price tickets will be checked at the entrance.
(2) Right to one’s own image
Each ticket holder irrevocably consents to the use of his/her image and voice free of charge for all present and future media for photographs, live broadcasts, broadcasts and/or recordings of images and/or sound made by the organizer or its agents in connection with the event.
(3) Filming and photography by spectators
Spectators are not permitted to film or take photographs at the event. Permission must be obtained from the organizer in advance. This also applies to the carrying of cameras.
(4) Bringing in food and drinks
It is not permitted to bring food and drink to the event.
